Subject: Consistency between the Green Claims Directive and the Packaging and Packaging Waste Regulation with regard to voluntary claims on recycled and bio-based content
The Commission proposal on the Green Claims Directive[1] sets out the substantiation requirements and verification process for voluntary environmental claims. The proposed Packaging and Packaging Waste Regulation[2] lays down rules on the recycled and bio-based content of packaging. It is envisaged that the methodology for calculating the recycled content will be defined under secondary legislation in relation to the draft Packaging and Packaging Waste Regulation.
In view of the above and considering that the legislative process for the regulation on packaging and packaging waste has not yet been completed:
1. Under which legislative act will voluntary claims about recycled and bio-based content be regulated?
2. What measures will be taken to ensure that the verification process complies with Article 10 of the Green Claims Directive?
3. How will consistency be ensured with regard to substantiation and verification if claims on different materials are regulated by different legislations?
