O acordo do trílogo que introduz alterações ao Regulamento n.º 561/2006 relativo aos requisitos mínimos em matéria de pausas mínimas e períodos de descanso diário e semanal no sector do transporte ocasional de passageiros representa um agravamento das condições de trabalho dos motoristas envolvidos, razão pela qual grupos representantes dos motoristas se opuseram à proposta desde o início.
O acordo introduz três derrogações aos requisitos mínimos relativos aos períodos de descanso diário e semanal que seriam aplicáveis ​​apenas aos serviços de transporte ocasionais. Este sector inclui operadores turísticos e aluguer de autocarros especiais ou privados, mas não serviços regulares de passageiros. As empresas que operam neste sector há muito que defendem que este segmento de mercado exige regras especiais devido à natureza sazonal do seu trabalho, e porque os tempos de condução e de pausa são irregulares e as distâncias envolvidas podem variar significativamente (por exemplo, longas pausas no meio do dia quando os turistas visitam um local).
Os sindicatos e os motoristas empregados opõem-se às mudanças porque representam um agravamento das condições de trabalho e podem aumentar a fadiga dos condutores, o que iria contra dois dos principais objetivos do regulamento: melhorar as condições de trabalho e melhorar a segurança rodoviária no setor dos transportes rodoviários. Estas opiniões contraditórias reflectem-se na consulta pública e na avaliação de impacto. Uma das principais razões apresentadas pela Comissão e pelos grupos políticos de apoio para justificar as alterações é que os condutores são frequentemente incomodados por passageiros que se ressentem de ter de parar com tanta frequência para pausas obrigatórias. Isto ignora o facto de que as pausas são concebidas para proteger os condutores e passageiros e a sua segurança, garantindo que os condutores estão adequadamente descansados. Tal como acontece com vários outros atos legislativos sobre transporte rodoviário, outro fator motivador para os proponentes desta legislação é a necessidade de resolver a questão da escassez de motoristas.
