PAN MEP urges Hungarian Constitutional Court to review law on transgender and intersex rights
Lisbon, 8 June 2020 – MEP Francisco Guerreiro (PAN) signed the letter to the Hungarian Commissioner for Fundamental Rights requesting that the bill is sent to the Constitutional Court for preliminary norm review, in order to guarantee compliance with European and international Human Rights standards.
The signatories write that the omnibus bill T/9934, and article 33 in particular, raise concerns relating to transgender and intersex person’s right to be free from discrimination and right to privacy, running counter to European and international human rights obligations.
“The before-mentioned article 33 will make it impossible to change a person’s sex in legal documents by requiring that documents such as birth, marriage and death certificates be changed to designate “sex at birth” instead of “sex”. This law will effectively deny access to legal gender recognition procedures to transgender and intersex persons in Hungary,” the letter states.
The letter is an initiative from the European Parliament’s Intergroup on LGBTI Rights, that made previous appeals to the revoking of this law before it was voted in the Hungarian Parliament.
